OTTAWA (AFP) - A Canadian court has lifted a 12-year-old girl's grounding, overturning her father's punishment for disobeying his orders to stay off the Internet, his lawyer said Wednesday.
The girl had taken her father to Quebec Superior Court after he refused to allow her to go on a school trip for chatting on websites he tried to block, and then posting "inappropriate" pictures of herself online using a friend's computer.
The father's lawyer Kim Beaudoin said the disciplinary measures were for the girl's "own protection" and is appealing the ruling.
"She's a child," Beaudoin told AFP. "At her age, children test their limits and it's up to their parents to set boundaries."
"I started an appeal of the decision today to reestablish parental authority, and to ensure that this case doesn't set a precedent," she said. Otherwise, said Beaudoin, "parents are going to be walking on egg shells from now on."
"I think most children respect their parents and would never go so far as to take them to court, but it's clear that some would and we have to ask ourselves how far this will go."
According to court documents, the girl's Internet transgression was just the latest in a string of broken house rules. Even so, Justice Suzanne Tessier found her punishment too severe.
Beaudoin noted the girl used a court-appointed lawyer in her parents' 10-year custody dispute to launch her landmark case against dear old dad.
I can't believe they took the authority away from the parents! How can a 12 year old take thier parent(s) to court? There was no crime committed except I guess the inapropriat pictures! This child, lawyer, and judge should all get a good old fashion butt belt woopin' for this! That is probably the whole reason this child disobeyed her father to begin with, the father probably hasn't used a belt in quite a while or ever, this is the same reason kids are spoiled now, the parents are too scared to use a belt becouse the child will scream child abuse. There is a difference, you can woop a child when they do wrong without breaking the skin, a few red marks and maybe a small bruise just shows the parent is doing its job, but breaking the skin is too far. The kid needs to cry and scream, then give them something to cry about! Don't do it out of anger do it out of love and let them know it! They won't understand until they get older but by #ell they will begin to listen and obey! ...........This was the tactics my Mom used on me and I turned out alright!

Note that she was represented by a guardian ad litem, and this was decided in her parent's 10 year custody battle. I wonder if dad has custody of the child, and if not, what mom's position was. That may be the crux of the issue, rather than parental authority in general.

I feel that kids are getting too many rights at a young age. They don't know how to handle them properly. I didn't have the right to back talk my parents when I was a kid. If I did I got a whoopin. I was grounded many times and I think it did me some good cause I know now the boundaries in life. I feel that if you don't have parents who care and who punish you when you do something wrong are the ones that are out there committing crimes. If mom and dad had been in the picture and in a positive way then this wouldn't be happening. JMHO
