Should the Carpenter's pig get to stay?
With the ongoing dispute between Dana McCants and Mr. and Mrs. James Carpenter of Bell Grayson road, many questions arise about the ownership of animals. The arguemnent in a nutshell is that Dana McCants says that the Carpenters can't have livestock (the pig) on their property due to the city ordiance of such, and as in all good arguments, the Carpenters feel they can.
The law states "No cattle, hogs, sheep, horses or other livestock... may be quartered, fed or otherwise kept in any area within the corporate limits of the city, which is zoned for residential use," the article reads. "Persons in possession of real property in excess of two acres which has been used for farming or raising livestock for more than five years next preceding the effective date of the ordinance from which this section is derived shall be exempted..." According to McCants, the property in question was annexed into the city in 1989. He claims that from 1982-1985 and from 1988-present, the property was farmed. But from 1986-1987, the property was not farmed. Because of that, McCants said the Bell Grayson Road property should not be grandfathered into the ordinance. (Demopolis Times)
The case has been kicked around in the city council for some time now, and was recently taken to the state Attorny General Bill Pryor. Due to the case not being a direct question of state law, Pryor rejected action into the dispute. So now it's back into the city's hands. It's looking like a long hard dispute for the both of them.
