Demopolis wins lawsuit against Taylor

In the Case of Vickie Taylor vs the City of Demopolis, the Judge W.B. Hand ruled in favor of the defendants: the City of Demopolis, Cecil Williamson, Jack Cooley, Charles Jones, Woody Collins, Melvin Yelverton, and Thomas Moore. According to the Times, Taylor's attorney states they plan to appeal the verdict with the 11th Circuit, stating "the law is contrary to the findings." He stated they are also considering "other courses of action".

The summary of judgement stated the charges did not strike them as "so outrageous in character and extreme in degree to go beyond all possible bounds of decency and to be regarded as atrocious and utterly intolerable in a civilized society." Complaints registered by Taylor included deprivation of rights without due process, violation of the Fair Labor Standards Act, failure to provide notice of her continuation of rights under the city's group health insurance plan, breach of contract, negligent supervision, tort of outrage, invasion of privacy, interference with a business relationship, false imprisonment based on her being escorted from City Hall, wrongful termination, and age discrimination.

My heart goes out the Vicky Taylor on this one. She was given the royal shaft and from I've heard now has a chance to lose everything she owns because of this. She feels the whole town is against her which of course isn't the case and I hope they do take it to a more unbiased court for review.

Dave...do you know where I can find the ruling? Did they try the case or did the court grant summary judgment?

Summary of judgment was granted. It was tried by the "Senior District Judge for the Northern Division of the Southern District of Alabama" of that helps.

For the legally challenged such as me...is a summary judgment a good thing or bad thing for Vickie? Does this just mean that it did not go before a jury and does she still have a shot at that with an appeal?

I also feel sorry for Vickie Taylor. I always found her to be courteous and helpful in city hall.

However, as I recall the Code of Alabama in regard to the appointment of a city clerk at the beginning of a new term of office for the mayor and council, there is no requirement that the previous clerk be given any special consideration. Furthermore, as I understand the law, the mayor has no authority to assure anyone that he or she will be the next city clerk. That is a decision for the city council, of which the mayor is but one member.
