Yesterday i was arrested for the first time in my life. Now mind you it is not the first time that i have done something to be arrested for, but in this case i dont believe i deserved to be taken into custody. Yesterday my 18 month old son climbed up on the couch and feel off knocking himself out. Being as my wife was on her way to a friends house i called 911 and then called my wife. The paramedics showed up shortly and by this time my son was awake and very agitated. We decided that since there was that moment of unconsciousness(sp) that he should be taken to the hospital to be checked out. As we were loading my son into the ambulance my wife drove up going a litttle to fast running over a couple of garbage can lids and screeching to a halt. I gave my son to her and she went with him in the ambulance. I went back to the house and backed the chld a few diapers and headed back outside. When i got outside the Mp's were waiting for me and told me that my vehicle had beeen in an accident and that i would have to stay there. Now let me tell you wht accidnt my vehicl had been in...........lol the freaking MP was talking about the garbage can lids that my wife ran over. I have a dent in my Drivers side bumper that has been in the for a while and that has yellow paint on it and the dent was on the wrong side of my vehicle.Well the MP tried to show this to her superior as the damage done by the garbage cans. I really think this person was being very well idiotic and those in the military would say gung-ho. Well back to me and my arrest. When the officer said that i could not leave and be with my son who had just had a siezure and then passed out in my arms well lets just say hat i was pissed off. Well i used some profanity and well a few other choice words. I mean here was this lady that was telling me that garbage cans were more important than my childs health. I was the parent here when the incident occured and could let the doctor know what my sons condition after the fall. Well neeedless to say i had to convey this info over the phone from my holding cell. I was charged with disorderly conduct and here is the kicker child neglegence resulting in an injury. Anyone who knows me knows that i am nearly paranoid when it comes to the well being of my children and because i left him alone for about 2 min as i was picking up the house i am a neglegent parent. Since i work with children at a local youth center this is liable to cost me my job as well. Thanks for letting me vent my frustration
Scott, that is horrible... I'm so sorry that happened to you. Just try and keep your chin up as best as possible.

Scott,if I were you I take it on to court.I was in the Army and I know that the MPs aren't the brightest people,but this is total "B.S.".I've known you since first grade and I definitely know that you would never harm your kids.By the way,how's he doing now?

Samuel is doing great. Doctor said Ct scan showed nothing out of the ordinary so he should be fine

This IS NOT funny in the least! Get a lawyer, and a damn good one! You do not want to be labeled a "child abuser" in any shape, form, or fashion. Accidents happen to everyone. I could understand if your child had shaken baby syndrome, cigarette burns all over, or burn marks on his butt where you set him on a hot stove eye, but a simple fall........geeeesh! And the "accident with the car"?? Did the MP see you operating the car? Looks like the burden of proof will be on her. I don't know what military procedure is, but in civilian law, she would have had to see you driving at the time of the accident to charge you for that.
On the other hand, glad your son is okay. Keep us posted!

Who around here hasn't been in jail at least once?
I beleive I can raise my hand for that one Rob. I've never had the misfortune of being arrested
Don't they count traffic tickets as an "arrest" too?

Well, I agree with Stickman about fitghting it. But you and I both know that military law enforcement have a totaly different way of dealing with cases and are usually hard to work with because they have that military mentality of 'just do what i say'. But I PRAY that everthing works out.

Actually stickman its was my wife that was operating the vehicle and it was her that ran over the Garbage can lids. You see this is what the whole deal is about she ran over "governtment property" and that is why i was not allowed to got to the hospital. So when i was told that i couldnt go i lost my temper and cused the MP like a dog. I love my kids and would never harm them in any way. I was scared to death that he was injured much worse than it turned out to be. But hey i was too busy waiting on the accident officer to arrive to know what his current condition. By the way when my son was released they had a MP waiting to arrest my wife for reckless driving............Can you believe this BS
Glad to hear little man is doing well.
I couldn't give advice on military law, except it seems to be much different from civilian law. If they are infact charging or albeling you a child abuser or accusing you of neglect, you have to fight that; however the process goes.

Yes, traffic tickets are an arrest. When you sign the traffic ticket, you are signing your own bond, promising to appear in court or pay the ticket before court date. If you really want a shocker, try refusing to sign the traffic ticket. Guaranteed ride to the pokey!
However, traffic tickets do not show up on your criminal history. They only show up on a driver history and are usually expunged (deleted) after five years with DUI's being an exception to that rule.
I'm glad your child is ok. I have never heard of a more frustrating situation in my life. Will you and your wife be able to attend a hearing to defend yourself against these charges? They do not have a space for explaining the charges on an arrest record. I would fight tooth and nail that these outrageous charges did not end up on my criminal history.
Hey Jeff,I was joking about the jail thing.And Stickman,I think they only stay of your record for three years.
Scott,are you saying that they are trying to charge you and Martha for the same "crime"?

I am being charged with disorderly conduct and she is being charged with reckless driving. Also for me there is the issue of child neglect which is BS so i will see the MP in court

Good Luck Scott. How fast do your command handle these cases, I hope they dont drag it out, That is just too much stress. Hope it all goes well. I'll keep praying for y'all.

Rob, most insurance companies only go back three years on a driver history. The actual convictions stay on your driver history for five years. If you want back-up on that, call the Driver License Division of the Alabama Department of Public Safety for confirmation. My father was a State Trooper for 18 1/2 years and the last three or four years he was with the state was in Driver License. That's how I know.
