It appears that Fox news has pulled the story. Anyway he was clad only in a cowboy hat, cowboy boots and carrying an american flag. He had been at an all night party!

So...does that count as desecrating the flag under the new proposed constitutional amendment?

We saw the actual Naked Cowboy in Times Square last week. Ironically, he was not naked, and I don't think he's a real cowboy either.

In other words, someone told him that he might be able to get out of the charges if he said his action constituted "free speech."

:D

Gotta hand it to him for being inventive, at least. But unfortunately, "[b]eing 'in a state of nudity' is not an inherently expressive condition," under City of Erie v. Pap's A.M., 529 U.S. 277 (2000), and this law will most assuredly pass the O'Brien test (391 U.S. 367 (1968)).

(Those cites are for your personal edification, fleming. :) Have fun.)

Wasn't he drunk in the 1st story that came about him?

Being drunk actually encourages freedom of speech. Just ask Mel Gibson.

"Kelley said he only marched to the end of his driveway, but regrets a church event was occurring in a nearby park at the time."

Who hasn't gotten naked, gone outside, and been confronted by the surprised stares and gaping mouths of the annual Baptist/Methodist Goodwill Softball Tournament players and fans.....it's ruined many a good time for me

Please keep your clothes on or be like Gerald Lynn Kelley (javascript:siteSearch('Gerald Lynn Kelley');), 52, who was charged with public lewdness. Might read something like this
," leagle , we dont know how old he was someone forgot to ask cause she was too busy starring, who was charged with public lewdness"
